Wyandotte CDL Case

Victory in Wyandotte County District Court!
On March 30, 2016, Michael S. Mogenson of Mogenson & Branson, LLC, lead the firm trial team to victory in an alleged DUI case being brought against a CDL licensed client. The State Trooper in this case was taken to task for violating his training pursuant to the National Highway Traffic Safety Administration manual.
After cross examination by Mr. Mogenson the Trooper had to admit that he did not perform the Standardized Field Sobriety Tests in the prescribed manner and that the validity of those test had been compromised.
Once it had been demonstrated that the State had no credible evidence of intoxication, the case was dismissed upon Mr. Mogenson’s Motion for a Judgment Acquittal without the defense having to present any evidence.
